Terms of Use

Effective Date: November 4, 2026

  1. Acceptance and Scope

Welcome to bevSavvy. This website, located at https://bevsavvy.com (the "Website"), is owned and operated by ReachFarther, Inc. ("ReachFarther," "we," "us," or "our"). bevSavvy® is a product of ReachFarther, Inc.

These Terms of Use ("Terms") govern access to and use of our public Website, including its informational pages, marketing materials, contact forms, and demonstration requests.

By accessing or using the Website, you agree to these Terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, please discontinue use of the Website.

These Terms apply only to the public marketing Website. They do not govern the separate bevSavvy software application, including app.bevsavvy.com, which is subject to its own agreements, terms, and applicable privacy disclosures.

Nothing in these Terms modifies, supersedes, or replaces any separate written agreement between ReachFarther and a customer or other party.

  1. Website Content and Product Information

The Website provides general information about bevSavvy, its capabilities, features, benefits, and availability.

We make reasonable efforts to keep this information accurate and current. However, product features, functionality, specifications, availability, pricing, and other information may change without prior notice.

Descriptions, illustrations, screenshots, demonstrations, testimonials, and other materials on the Website are provided for informational and promotional purposes. They do not constitute a binding offer, guarantee of particular results, or contractual commitment unless expressly incorporated into a separate written agreement.

Actual product functionality, service commitments, pricing, and other contractual obligations are governed by the applicable agreements for the bevSavvy software application.

Any calculator, estimator, or similar tool on the Website, and any results it produces, is provided for illustration only. Results are estimates based on the information you enter and general assumptions. They are not a quote, proposal, or offer, and they do not guarantee pricing, savings, or outcomes. Actual pricing and terms are set only in a separate written agreement for the bevSavvy software application.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded, including rights relating to false or misleading representations.

  1. Intellectual Property

The Website and its contents, including text, graphics, photographs, videos, logos, designs, software descriptions, and other materials, are owned by ReachFarther, Inc. or its respective licensors and are protected by applicable intellectual property laws.

The bevSavvy name, logo, and associated branding are trademarks or other proprietary identifiers of ReachFarther, Inc.

You may access, view, and print reasonable portions of the Website for personal, informational, or legitimate internal business evaluation purposes.

Except as permitted by applicable law or with our prior written authorization, you may not reproduce, republish, distribute, modify, sell, license, or commercially exploit Website content.

Nothing in these Terms grants any ownership interest or license in our trademarks, software, proprietary technology, or other intellectual property, except for the limited permission to access and use the Website as described above.

Third-party names, trademarks, and materials remain the property of their respective owners.

  1. Acceptable Use

You agree to use the Website only for lawful purposes and in a manner that does not interfere with its operation or the rights of others.

You may not:

  • Attempt to gain unauthorized access to the Website, its servers, databases, or related systems.
  • Introduce malicious code, viruses, or other harmful technologies.
  • Interfere with, disrupt, or compromise the security or performance of the Website.
  • Use automated tools to scrape, harvest, or systematically extract Website content or information without authorization, except as permitted by applicable law.
  • Misrepresent your identity or submit fraudulent, misleading, or malicious information through Website forms.
  • Use the Website in violation of applicable laws or regulations.

We reserve the right to restrict or block access to the Website when reasonably necessary to protect its security, integrity, or availability, subject to applicable law.

  1. Contact Forms and Communications

Our Website allows visitors to submit inquiries, request demonstrations, and communicate with us.

By submitting information through a Website form, you represent that the information you provide is accurate to the best of your knowledge and that you have the authority to provide it.

Submitting a form does not create a customer relationship, service agreement, or obligation for ReachFarther to provide services.

We may use the contact information you provide to respond to your inquiry and communicate with you regarding bevSavvy, as described in our Privacy Policy.

Any subscription to the bevSavvy software application requires a separate agreement and is not established merely by submitting a Website form.

Please do not include sensitive information, such as financial account numbers, government identifiers, or health information, in your messages. For how we handle information you submit, see Section 9 and our Privacy Policy.

If you voluntarily submit suggestions, ideas, or feedback regarding bevSavvy, you grant ReachFarther, Inc. a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and incorporate that feedback into our products and services without compensation or obligation to you, to the extent you have the rights necessary to grant such a license. Please do not submit confidential information or materials belonging to third parties without authorization.

  1. Third-Party Websites and Services

The Website may contain links to third-party websites, resources, or services for convenience or informational purposes.

ReachFarther does not control these third-party websites and is not responsible for their content, availability, security, or privacy practices.

The inclusion of a third-party link does not necessarily imply endorsement, sponsorship, or affiliation.

Your use of third-party websites and services is subject to their respective terms and policies.

  1. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

ReachFarther disclaims all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, completely secure, or free from harmful components, or that all information presented will be accurate, complete, or current at all times.

We may modify, suspend, or discontinue any portion of the Website without prior notice, subject to applicable law.

These disclaimers apply only to the public Website and do not modify any express warranties or obligations contained in separate written agreements governing the bevSavvy software application.

Nothing in this section excludes warranties or protections that cannot lawfully be disclaimed.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REACHFARTHER, INC., ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ACCESS TO OR USE OF THE WEBSITE.

This includes, without limitation, loss of profits, business opportunities, data, or goodwill, whether arising under contract, tort, or another legal theory, even if advised of the possibility of such damages.

To the extent permitted by applicable law, ReachFarther's total aggregate liability for claims arising solely from access to or use of the public Website shall not exceed one hundred U.S. dollars (US $100).

These limitations do not apply where prohibited by law, including liability that cannot legally be limited or excluded, and they do not limit liability for fraud, gross negligence, or willful misconduct. Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the limitations in this section apply only to the extent permitted by law.

This section does not limit or modify liability arising under a separate written agreement governing the bevSavvy software application.

Any dispute arising from these Terms or your use of the Website shall be brought in the state courts located in Morris County, New Jersey, or the federal court serving that county, and you consent to the personal jurisdiction and venue of those courts, to the extent permitted by applicable law.

Nothing in this section limits mandatory rights or remedies available to individuals under applicable law.

  1. Changes to These Terms
